As a user of our photo service, you agree to the following:

Your Eligibility

You must be eighteen or over to use this service. No exceptions. By using the Web Site, you represent that you have the legal capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. By agreeing to our terms and conditions, you declare that the information that you disclosed on the site is correct and that you agree to pay for our service at the current advertised rate.

Payments

Payment in full is required prior to the photo session. We use SSL encryption, so your order is completely secure.

Cancellation

If you must cancel your photo shoot and you notify us at least 36 hours prior to the time of the photo shoot, we will refund your payment in full. There is a fee if you cancel less than 36 hours prior to the photo shoot, you must contact BetterBusinessShots.com directly to receive a refund for the remaining amount.

Cancalation fee:

Economy Package: $60
Silver Package: $70
Gold Package: $80
Platinum Package: $100

If you do not contact both BetterBusinessShots.com and your photographer and do NOT show up on the date/time of your scheduled photo session your payment will NOT be refunded. If you need to reschedule your photo session, you must do so within 30 days of your original photo shoot date. If you do not show up for your rescheduled photo shoot, we will not be able to reschedule your photo shoot for a third time and you will not receive a refund.

Refunds

If you are unhappy with your photos, we can either give you a free re-shoot or refund your money. If we give you a reshoot, you will not be able to get any refund if you don't like your photos the second time. It is your responsibility to tell the photographer what kind of photos you'd like to get and make sure you get them. If you choose to not have a reshoot, we will give you a refund for the amount paid minus a sitting fee. The sitting fee is non-refundable. Optional services are non-refundable.

Economy Package: $60
Silver Package: $70
Gold Package: $80
Platinum Package: $100

Plus, $15 if you ordered location shoot

Any complaint should be communicated in writing to within 14 days after the photo shoot. No refunds will be entertained for any reason after this period.

Indemnity

You agree to indemnify and hold BetterBusinessShots, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, due to or arising out of your use of the Service.

Liability Limitation

Except in jurisdictions where such provisions are restricted, in no event will BetterBusinessShots.com be liable to you or any third person for any indirect, consequential, incidental, special or punitive damages, including lost profits arising from your use of the Web Site or the Service, even if BetterBusinessShots.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, BetterBusinessShots.com's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to BetterBusinessShots.com for the Service during the term of membership.

Disputes

If there is any dispute about or involving the Web Site and/or the Service, by using the Web Site, you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California, City of Long Beach.

Newsletters

Once you've purchased any of our services, you are automatically enrolled in our mailing list. We may send you newsletters from time to time to let you know about new services or to announce a promotion/contest/survey. We will not sell your information to third parties. You may choose to opt-out of the newsletter at any time by following the unsubscribe instructions at the bottom of the newsletter.

Quality

BetterBusinessShots will do its best to contract the best portrait photographer for you and get you the best portrait photographs that we can. Although every effort will be made to ensure your satisfaction, individual results may vary.

Other

Prints and high resolution images are not a part of the package. You get 6-24 photos ready to use online only. If you'd like prints or high-resolution images, you will have to order it directly from your photographer for a separate charge. This Agreement contains the entire agreement between you and BetterBusinessShots.com regarding the use of the Web Site and our service. If any provision of this Agreement is determined to be invalid, the remainder of this Agreement shall continue in full force.
